The Office of the General Secretary August 10, 2018

An order to grant the Attorney General full prosecutorial independence from the rest of the executive government

By the authority vested in me as General Secretary of TCB by the Constitution and the laws of the People's Republic of The Communist Bloc, I hereby order as follows:

Definitions and Clarifications

1. The Attorney General is the Chief Prosecutor of The Communist Bloc. 2. The office of the Attorney General is an office of the executive branch, which the General Secretary with the advice and consent of their Deputy has the power to change the composition of and abolish at will. 3. Due to their status as the Chief Prosecutor of the region, the Attorney General should be given as much independence as possible, especially in cases where members of the executive branch are to be prosecuted.

Executable Actions

1. The Ministry of Justice and the Attorney General are hereby established as separate entities and positions within the executive. The Minister of Justice shall hold the responsibility of Chief Legal Advisor, and the Attorney General shall hold the powers of Chief Prosecutor. 2. The Minister of Justice shall represent the executive government in court, while the Attorney General shall prosecute on behalf of the state, upholding our laws and values. 3. The Attorney General may use their discretion as to when and what to prosecute, in the best interests of the region. 4. The Attorney General is to be appointed by the General Secretary with the advice and consent of their Deputy, but must be removed via referendum and not unilaterally by the executive. 5. The Attorney General is entitled to their own private and secure communication networks, such as Discord servers/chats, that are private to everyone (including other executive branch officials) except the Attorney General and their chosen staff. 6. The Administrative Council may gain access to these channels during an investigation with the consent of the general populace via referendum.
